Dave Hatter on Fox19 (WXIX) RE What happens to your digital assets after you die?

I was interviewed by Shelia Gray on September 26th, 2012 for the Fox 19 Morning News. We discussed what happens to your digital assets after you die?

Some of the key concepts we discussed include:

  • Digital Assets are more than social media accounts; they include online bank accounts, Ebay, Amazon, e-mail, photos, music, books, games, etc. The Cloud makes this problem bigger.
  • Some states have passed Internet probate laws including Connecticut and Rhode Island, most haven’t
  • U.S. General Services Administration recommends people set up a “social-media will” and have an “digital executor”
  • Choose your digital executor carefully, should be familiar with technology
  • Review the privacy policies and terms and conditions of each website; stipulate in your traditional will that the “digital executor” get a copy of the death certificate which might be needed to gain access to an account.
  • What do you want to happen? Keep accounts open, close them or something in between?
    • Do you want family to have access to “private” information?
    • Twitter and Facebook allow a deceased users accounts to be removed the proof of a death certificate. Facebook offers the option to turn a profile into a memorial page that allows posting
  • Be clear about what you want done. Doing nothing leaves the fate of your accounts and assets up to courts or next of kin.
  • Keep accounts and passwords separate from your will, wills become public records and your accounts maybe exposed. Update regularly
  • Check out paid services to help plan your digital estate:
  • DeadSocial (http://deadsoci.al/) will allow you to continue posting after death, one final message or periodic messages
